2. Eligibility and Account Registration

Our Services are intended for individuals aged 18 or older.

By using our Services, you represent that you are at least 18 years old and legally capable of entering into binding agreements.

Certain Services require you to create an account. You agree to provide accurate, current, and complete information and to keep your account information updated.

You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

Please notify us promptly at support@letspause.com if you suspect unauthorized account access.

3. Use of Our Services

You agree to use our Services only for lawful purposes and in accordance with these Terms.

You may not:

• Use our Services for fraudulent, unlawful, or unauthorized purposes.
• Copy, distribute, sell, or reproduce proprietary content without written permission.
• Share paid account access or restricted program materials without authorization.
• Interfere with the operation or security of our websites, applications, or platforms.
• Harass, threaten, discriminate against, or otherwise harm other participants, instructors, or team members.
• Upload or distribute material that infringes another person's intellectual property or legal rights.

We may restrict or suspend access when these Terms are violated, subject to applicable law and contractual obligations.

4. Products, Programs, and Services

Pause Breathwork offers a range of educational, coaching, wellness, and professional development experiences.

These may include:

• Breathwork and Somatic Coaching Certification (BSCC)
• Other professional training and certification programs
• LIFE Mastermind and other mastermind programs
• Online courses and educational workshops
• Memberships and subscription-based services
• Breathwork audio journeys and digital content
• Live events, retreats, and in-person experiences
• Mobile application subscriptions and purchases
• Other products and services introduced by Pause Breathwork

Program content, schedules, instructors, delivery methods, eligibility requirements, and availability may vary.

We reserve the right to update or improve our offerings, provided we honour applicable contractual obligations and consumer rights.

5. Purchases and Payment Obligations

By purchasing a product or enrolling in a paid Service, you agree to pay the applicable fees presented at checkout or specified in your enrollment agreement.

Payments may be collected through authorized third-party payment processors or applicable application stores.

If you select a payment plan, you agree to the payment schedule and obligations stated in your purchase or enrollment agreement.

Unless otherwise specified in writing, enrolling in a payment plan does not convert a fixed-price program purchase into a month-to-month subscription.

You remain responsible for payments owed under your applicable agreement, subject to mandatory consumer protection laws and any cancellation or rescission rights.

If a payment fails or becomes overdue, we may contact you to resolve the balance and may restrict access where permitted by your agreement and applicable law.

6. Cancellations, Refunds, and Rescission Rights

Refunds and cancellations are governed by the terms applicable to the product or Service purchased, including any enrollment agreement and mandatory consumer protection laws.

Certifications and Professional Training Programs

For the Breathwork and Somatic Coaching Certification (BSCC) and other applicable professional training programs, participants have a three-day rescission period beginning the day after the agreement is signed or participation is confirmed through active consent.

After the rescission period, purchases are non-refundable, except where otherwise required by law or expressly provided in the applicable enrollment agreement. Deferrals to future cohorts are not permitted unless authorized in writing by Pause Breathwork.

LIFE Mastermind

LIFE Mastermind participants have a three-day rescission period beginning the day after the agreement is signed or participation is confirmed through active consent.

After the rescission period, purchases are non-refundable, except where otherwise required by law or expressly provided in the applicable enrollment agreement.

Digital Products, Courses, and Other Programs

Refund eligibility for digital products, courses, and other programs is governed by the applicable purchase terms and mandatory consumer rights.

Events and Retreats

Event and retreat purchases may be subject to separate registration, cancellation, transfer, and refund conditions disclosed at the time of purchase.

General Conditions

Where a separate signed enrollment agreement or product-specific purchase policy applies, its terms govern the relevant purchase, subject to applicable law.

Nothing in these Terms limits rights or remedies that cannot legally be excluded.

7. Mobile Application Terms

The Pause Breathwork mobile application provides access to selected breathwork, meditation, wellness, and related digital content.

Some application features may be available free of charge, while others require a paid monthly subscription or in-app purchase.

Your use of the application is subject to these Terms, our Privacy Policy, and applicable Apple App Store or Google Play terms.

We may update the application, modify available content, correct technical issues, or discontinue features, subject to applicable law and existing purchase commitments.

Pause Breathwork may introduce additional free features or make the application available without a subscription in the future. Any such changes will be communicated as appropriate and will not override existing consumer rights.

8. Mobile App Subscriptions and Automatic Renewal

Where offered, Pause Breathwork mobile app subscriptions are billed monthly at the price disclosed during purchase.

Unless cancelled before renewal, subscriptions automatically renew each month at the applicable subscription price, subject to the terms presented at purchase and applicable law.

For subscriptions purchased through Apple's App Store, billing and subscription management are handled through Apple.

For subscriptions purchased through Google Play, billing and subscription management are handled through Google.

You can manage or cancel an app-store subscription through the applicable store's subscription settings.

Cancelling a subscription generally prevents future renewals and does not automatically provide a refund for the current billing period.

Where permitted by applicable law and the relevant application store's policies, access may continue until the end of the paid subscription period.

Deleting the application or your account does not necessarily cancel an active subscription. You should separately cancel the subscription through the applicable store.

Pause Breathwork may modify or discontinue subscription offerings, including transitioning the application to a free-access model. Any changes affecting existing subscribers will be handled in accordance with applicable laws, app-store requirements, and the terms of their subscriptions.

9. In-App Purchases and Refunds

In-app purchases may provide access to premium content, subscriptions, or other digital features.

Purchases processed through Apple or Google are subject to the relevant application store's billing and refund policies.

If you purchased a subscription or digital product through an application store, refund requests should generally be submitted through that store.

For purchases made directly through Pause Breathwork, the applicable purchase agreement and refund terms will apply.

Nothing in this section limits any non-waivable consumer rights.

10. Free Trials and Promotional Offers

We may offer free trials, introductory pricing, discounts, or other promotions.

The duration, eligibility requirements, renewal pricing, and cancellation conditions will be disclosed as part of the applicable offer.

Where a free trial converts to a paid subscription, the billing conditions presented at enrollment will apply.

Promotions may be subject to additional terms, and we reserve the right to modify or discontinue offers for future customers, subject to applicable law.

11. Certification Requirements and Continuing Education

Participation in the Breathwork and Somatic Coaching Certification (BSCC) or another professional training program does not automatically guarantee certification, graduation, professional accreditation, employment, or any particular business outcome.

Students must satisfy the educational, attendance, assessment, conduct, and payment requirements specified in their applicable program agreement.

Certificates are issued only when the relevant program requirements have been satisfied.

Pause Breathwork is approved as an International Coaching Federation (ICF) Continuing Coach Education (CCE) provider.

Where applicable, eligible Pause Breathwork educational programs may qualify for ICF Continuing Coach Education credits in accordance with the requirements and approvals established by the ICF.

Completion of a Pause Breathwork program does not, by itself, grant an ICF coaching credential or guarantee eligibility for professional accreditation.

Any third-party continuing education recognition or accreditation applies only to the programs and conditions expressly approved by the relevant organization.

12. Events, Retreats, and In-Person Experiences

Participation in live events, retreats, or in-person programs may require separate registration, payment, waivers, or participation agreements.

Participants are responsible for reviewing event-specific requirements, including travel arrangements, accommodations, health considerations, and cancellation policies.

We may make reasonable changes to event schedules, speakers, venues, or programming when necessary.

Where a material change affects a purchased event, any remedies will be determined under the applicable purchase agreement and mandatory consumer protection laws.

13. Wellness and Medical Disclaimer

Pause Breathwork provides breathwork, meditation, somatic coaching education, and general wellness experiences.

Our Services are intended for educational, personal development, and wellness purposes.

They are not medical services and are not intended to diagnose, treat, cure, or prevent any medical or psychological condition.

Breathwork practices may involve physical or emotional responses and may not be suitable for everyone.

You should consult an appropriate healthcare professional before participating if you have medical concerns, are pregnant, have a relevant medical or psychological condition, or are uncertain whether a particular practice is suitable for you.

Participants should review all applicable safety instructions and contraindications before engaging in breathwork practices.

You are responsible for participating within your own capabilities and following the safety instructions provided for each experience.

Discontinue any activity that causes significant discomfort or concerning symptoms and seek appropriate medical attention when necessary.

Do not engage in breathwork exercises while driving, operating machinery, or participating in activities where changes in awareness could create a safety risk.

14. No Guarantee of Results

Individual experiences and outcomes vary.

We do not guarantee specific health, emotional, financial, business, professional, or personal results from participating in our Services, except where an express written guarantee is included in an applicable purchase agreement.

Testimonials and examples are provided for illustrative purposes and do not guarantee similar outcomes.

15. Intellectual Property

All original content provided through our Services, including videos, audio recordings, course materials, training frameworks, written materials, graphics, branding, and software, is owned by or licensed to Hungry for Happiness LLC d/b/a Pause Breathwork.

Unless expressly authorized in writing, you may not reproduce, distribute, publish, resell, sublicense, or commercially exploit our proprietary materials.

Purchasing a product or enrolling in a program grants you a limited, personal, non-transferable right to access and use the purchased materials for their intended purpose, subject to your agreement.

No ownership rights are transferred through your purchase.

16. User-Submitted Content, Recordings, and Testimonials

You retain ownership of content you lawfully submit to our Services, including written contributions, feedback, and other original materials.

By submitting content to us, you confirm that you have the necessary rights and permissions to share it.

Program Recordings

Certain coaching sessions, educational workshops, training calls, and group programs may be recorded for educational, training, and program delivery purposes.

Where sessions are recorded, participants will be informed in advance or at the beginning of the session. Recordings may be made available to enrolled participants, authorized instructors, and relevant Pause Breathwork team members for legitimate program purposes.

We take reasonable steps to protect the privacy of participants and limit access to recordings as appropriate.

Testimonials and Promotional Content

We may invite participants to share testimonials, reviews, feedback, photographs, videos, or personal experiences.

We will obtain appropriate permission before using identifiable participant content, including names, images, voices, testimonials, or personal stories, for public marketing, advertising, or promotional purposes.

Participation in a program does not automatically grant Pause Breathwork permission to use private coaching discussions or personal disclosures for promotional purposes.

Participant Privacy and Confidentiality

Participants agree to respect the privacy and confidentiality of others in group coaching sessions, training programs, and community discussions.

You may not record, reproduce, distribute, publish, or share another participant's personal information, disclosures, or contributions without appropriate authorization.

Content Permissions

Where you expressly authorize Pause Breathwork to use your content, the scope and duration of that permission will be governed by the applicable consent, release, or written agreement.

You may contact support@letspause.com with questions or concerns regarding content you have submitted or authorized for use.

17. Community Standards

Some Services may include group coaching, online communities, student discussions, or live participation.

You agree to respect other participants' privacy, confidentiality, and personal boundaries.

You may not record, distribute, or publicly share another participant's personal disclosures without appropriate permission.

We may moderate or restrict participation where necessary to maintain a safe and respectful environment, subject to applicable agreements and law.

18. Third-Party Platforms and Services

We may use third-party platforms to deliver content, manage payments, host communities, communicate with customers, or provide technical functionality.

These platforms may have their own terms and privacy policies.

We are not responsible for independently operated third-party services except as required by applicable law.

19. Privacy

Our collection, use, disclosure, and retention of personal information are described in our Privacy Policy. Read our Privacy Policy.

Please review the Privacy Policy for information about your privacy rights and how to contact us with privacy-related requests.

20. Suspension and Termination

We may suspend or terminate access to Services where a user materially breaches these Terms, engages in unlawful activity, compromises security, or violates applicable program participation requirements.

Where reasonably appropriate, we may provide notice and an opportunity to resolve the issue.

Termination does not eliminate payment obligations that remain enforceable under an applicable agreement.

You may request account deletion or assistance by contacting support@letspause.com.

21. Disclaimer of Warranties

To the fullest extent permitted by applicable law, our Services are provided on an "as is" and "as available" basis.

We do not guarantee that our websites, applications, or digital platforms will operate without interruption or technical error.

Nothing in these Terms excludes warranties or statutory protections that cannot legally be excluded.

22. Limitation of Liability

To the fullest extent permitted by applicable law, Hungry for Happiness LLC d/b/a Pause Breathwork and its authorized representatives will not be liable for indirect, incidental, special, or consequential losses arising from use of the Services.

Any applicable limitation of liability will be subject to mandatory consumer protection laws and will not exclude liability that cannot legally be limited or excluded.

23. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, except where mandatory laws of another jurisdiction apply.

If a dispute arises, you agree to first contact Pause Breathwork at support@letspause.com so that we may attempt to resolve the matter informally.

If the dispute cannot be resolved informally, the parties agree to attempt mediation before commencing litigation, where permitted by applicable law.

Subject to applicable consumer protection laws and any mandatory jurisdictional requirements, disputes arising under these Terms shall be resolved in the appropriate courts located in San Diego County, California.

Nothing in these Terms limits any rights or remedies that cannot legally be excluded.

24. Changes to These Terms

We may update these Terms periodically to reflect changes in our Services, business operations, technology, or applicable laws.

The current version will be published on our website with its updated effective date.

Where legally required, we will provide notice of material changes.

Changes will not retroactively override rights established under an existing purchase agreement where prohibited by law.

25. Severability and Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

Our failure to enforce a provision does not constitute a waiver of our right to enforce it later.
